THE NEW SCHOOL YEAR BRINGS NEW SCHOOL LAWS

July 1 marks the first day of the new fiscal year for school districts.  It also marks the first effective day for several laws affecting school districts.  Following is a summary of some of the new laws:

  • The uniform cost accounting informal bid limit will be raised to $175,000.  Previously, the informal bid limit was set at $125,000.  (See Lozano Smith Client News Brief No. 17, May 2011.)
  • The whooping cough booster (Tdap) is required for all students entering or advancing into 7th to 12th grade.  Students are required to submit proof of a Tdap booster shot before entering school starting the 2011-2012 school year, or provide a waiver/affidavit specifically exempting them from the Tdap vaccination based upon a medical or personal beliefs exemption.  Efforts are reportedly under way to add into law a brief grace period at the beginning of the 2011-2012 school year, extending the time for this immunization requirement.    
  • Classroom security locks will be required for new construction.  All new school construction projects must have doors that can be locked from the inside.  This applies to all classrooms and any rooms with an occupancy of five or more, excluding doors that are locked at all times from the outside and student restrooms.  (See Lozano Smith Client News Brief No. 42, Oct. 2010.)
  • Access to free, fresh drinking water during meals in school food service areas must be provided by the school district.  Districts must adhere to this new regulation unless fiscal constraints or health and safety concerns prevent compliance.  This law intends to promote water consumption and minimize the consumption of sugar-sweetened beverages in an effort to help fight obesity.  (See Lozano Smith Client News Brief No. 50, Nov. 2010.)
